The Legal System Used to be So Cool

From the excellent [Now I Know](http://nowiknow.com) newsletter:

> Thornton was invoking his right to a trial by battle, a custom stemming from the Normans nearly a millennium earlier. It was simple: someone accused of a crime and not obviously guilty – Wikipedia says ”in the absence of witnesses or a confession” — could settle the matter by duking it out against his accuser. The theory was that the Almighty would ensure that the outcome be the one in line with the goals of a just society — after a lot of bruises, bleeding, and broken bones, of course. And while trial by battle (also called “trial by comabt”) disappeared almost entirely (in Europe, at least) by the 16th century — humanity concluded that incorporeal beings tend not to meddle in the affairs with mere mortals, at least not in cases like these — Parliament never got around to actually revoking the law. So the Ashford v Thornton court allowed it.

I wonder how this could be applied to software copyright disputes? Maybe a game of Mario Kart?

Amazon Launches Kindle Matchbook

Amazon has launched their new [Kindle Matchbook](http://www.amazon.com/gp/feature.html?ie=UTF8&docId=1001373341) service, which reviews your previous book purchases to determine if you’re eligible for discounted Kindle versions. As you would expect, only a few publishers are signed up at the moment, but hopefully this program will go as time goes on.[^fn1]

[^fn1]: Currently, I have about 20 books that I could get eBook versions for, ranging in prices of $1.99 to $2.99.

Bud Selig says he’d ‘listen’ to talk about changing the DH rule

Even though this statement does not translate into any real action, I am glad to here the issue at least given lip service. With year-long interleague, the DH rule split is stupid. Relatedly, having pitchers bat is stupid. It is time the NL gets the DH too and we can move on with modern baseball.

Marco Arment on Salary Ranges in Job Listings

Koji Uehara picks off Kolten Wong to leave Cards ‘dumbfounded’ while Quintin Berry feels ‘invincible’

Papi reminds the Red Sox that “This is Our Time”

No one has the full text of the speech,[^fn1] but the summaries make it sound pretty powerful:

> “He just said, he called us all together and said, ‘Hey guys — this opportunity doesn’t come around very often. Let’s seize the moment, let’s have fun, let’s be ourselves. Let’s have some fun. Let’s go out there and let’s get after it, let’s play our game.’ And we did that. He, that guy, he leads by example, he leads by his voice, he keeps you loose, he gets on you when he needs to. He’s a great teammate. When that guy speaks, you listen, in the postseason especially.”

and

> “It was pretty powerful,” bench coach Torey Lovullo said. “I wasn’t exactly sure what he was going to say. He brought up some good points. This is our time. Let’s play our type of baseball. It was a pretty powerful moment. Everyone came together and rallied behind those words.

It seemed to help yesterday. Hopefully, it will help tonight too.

Jonah Keri Goes through the Craziness of the World Series

As always, Jonah’s piece is tremendous. The last line, however, deserves special treatment:

> In a series with two very good, somewhat flawed, evenly matched clubs, the team that makes the best decisions — and stops making errors every other play — could be the one to beat.

It feels like *all* of the errors have been on the Sox side since Game 1. Hopefully, that will change tonight.

Jeff Passan discusses Big Papi’s Hall of Fame Chances

> Numbers aren’t the true issue for Ortiz. When The New York Times reported Ortiz tested positive for a PED in 2003, he denied having taken it. While there was a loophole – reportedly eight of the 104 players on the list from the survey testing had used 19-nonandrostenedione, a tainted supplement – it never has been confirmed Ortiz was one of the eight. And considering mere PED speculation left this year’s class empty, the presence of a positive, no matter what caused it, may initiate a death blow before his candidacy even begins.

That New York times article was ridiculous at the time, and it is even more ridiculous now to look back at it. If some random hack writer for a once-great newspaper can end someone’s hall-of-fame chances, then something is seriously wrong with the selection process.

How April in Portland prepared Xander Bogaerts for the World Series

> The Sea Dogs had a game postponed this season due to the cold — an April contest when the field froze overnight and couldn’t thaw the next day in 35-degree temperatures. Bogaerts got off to a slow start in the cold in April, but it lasted only 10 games. After going 7-for-41 those first 10 games, Bogaerts hit .432 the rest of the month.

> That experience in Portland helped prepare Bogaerts for this time of year in Boston and St. Louis. The game-time temperature for Game Two of the World Series was 49 degrees — three degrees warmer than Opening Day at Hadlock Field. It’s supposed to be about 48 for the first pitch in St. Louis Saturday night.

The time in Maine definitely seems to have paid off. Bogearts has been raking during the series.[^fn1]
